Terms of Service
1. Purpose
These Terms of Service (hereinafter "Terms") govern the contractual relationship between:
- Service Provider: [COMPANY NAME], operating under the commercial brand inyx.io (hereinafter "inyx.io")
- Client: any natural or legal person who subscribes to one of the services offered by inyx.io
These Terms define the conditions under which inyx.io provides web hosting services to the Client.
2. Acceptance of Terms
Ordering an inyx.io service constitutes full and complete acceptance of these Terms. This acceptance is materialized by checking the acceptance box during ordering in the client area.
The applicable Terms are those in effect on the date of order. inyx.io reserves the right to modify them (see Section 17).
These Terms supersede any document issued by the Client (purchase order, etc.) unless otherwise agreed in writing and signed by both parties.
3. Service Description
3.1 Shared Hosting
Web hosting service shared on inyx.io infrastructure. The Client benefits from storage space, bandwidth, databases, and a control panel, shared with other clients in an isolated environment.
- NVMe SSD Storage: according to subscribed plan
- Traffic: unlimited within normal usage (see Section 9)
- Let's Encrypt SSL: included and auto-renewed
- Enhance Control Panel: included
3.2 WordPress Hosting
Shared hosting service optimized for WordPress, including automatic WordPress installation, advanced caching (Redis + OPcache), automatic WordPress core updates, and WordPress-specific security measures.
3.3 Private Node
Hosting service on a private node exclusively for the Client, providing guaranteed CPU, RAM, and storage resources, total isolation, and a segregated environment. Exact specifications are subject to a personalized quote and specific contract.
Note: Private Node is a software-level dedicated node managed via the Enhance panel. It is not a physical dedicated server (baremetal).
4. Ordering and Account Creation
Ordering is done via the inyx.io client area (ClientExec) accessible at clients.inyx.io.
The Client must:
- Create an account with accurate, complete, and current information
- Be of legal age (18 years or older) or legal representative of a legal entity
- Provide a valid and functional email address
The Client is responsible for maintaining the confidentiality of their login credentials. inyx.io cannot be held responsible for unauthorized access resulting from Client negligence.
Any order is final from the moment payment is validated. A confirmation email is sent to the Client with details of the subscribed offer.
5. Pricing and Billing
Prices are stated in euros (€), inclusive of taxes (ITC) for individuals, and excluding taxes (ETC) for professionals subject to VAT. The applicable VAT is that in effect at the time of invoicing.
inyx.io reserves the right to modify its prices at any time. New pricing will be communicated to the Client with 30 days' notice by email. Renewal of the subscription after this date constitutes acceptance of the new prices.

6. Payment Terms
Payment is made online via accepted methods in the client area (credit card, SEPA transfer, etc.). Payment data is processed by a secure PCI-DSS certified payment provider. inyx.io never stores raw bank account data.
In case of payment default at the due date, inyx.io reserves the right to:
- Suspend the service after a 7-day period following reminder
- Terminate the contract after 30 days of non-payment
- Charge late payment interest at the legal rate in effect
7. Term and Renewal
Subscriptions are taken out for a monthly or annual period at the Client's choice. They renew automatically by tacit renewal at expiration unless terminated as per Section 8.
The Client is notified of renewal by email 15 days before expiration.
8. Termination
8.1 Termination by Client
The Client may terminate their subscription at any time from their client area. Termination takes effect at the end of the current period. No prorata refund is made for monthly subscriptions. For annual subscriptions, a prorata refund of remaining months may be granted at inyx.io's discretion upon written request, excluding processing fees.
8.2 Right of Withdrawal
In accordance with applicable consumer protection laws, a consumer Client (natural person not acting in a professional capacity) has 14 calendar days from the date of order to exercise their right to withdraw without providing justification. This period applies only if the service has not yet been activated and used.

8.3 Termination by inyx.io
inyx.io may terminate the contract outright, without notice or compensation, in case of:
- Serious and repeated violation of these Terms
- Use of the service for unlawful purposes
- Non-payment after reminder
- Provision of false information when ordering
8.4 Data After Termination
Following termination, the Client has 7 days to retrieve their data via FTP or the client area. After this period, data will be irreversibly deleted. inyx.io is not responsible for data lost after this period.
9. Client Obligations
The Client commits to using inyx.io services in accordance with applicable law and these Terms. It is particularly forbidden to:
- Host illegal content (child exploitation material, incitement to hatred, counterfeiting, etc.)
- Use resources for spam, phishing, or unsolicited mailing activities
- Conduct cyberattacks (DDoS, vulnerability scanning, etc.) from inyx.io servers
- Consume resources abusively harming other users (shared hosting)
- Host malware, viruses, or any malicious code
- Attempt to access other clients' environments
- Resell inyx.io services without prior written authorization
The Client is solely responsible for the content they host and activities conducted from their hosting. They commit to keeping their software (CMS, plugins, etc.) updated for security reasons.
10. inyx.io Obligations
inyx.io commits to:
- Provide services in accordance with the description and specifications of the subscribed plan
- Ensure service availability according to the SLA defined (Section 11)
- Perform daily backups and maintain them for 30 days
- Notify the Client of any planned maintenance with at least 48 hours' notice
- Process support requests within announced timeframes
- Protect Client data in compliance with the GDPR
11. Availability and SLA
inyx.io commits to a monthly uptime rate of 99.9% for Shared and WordPress services, excluding:
- Planned maintenance (notified 48 hours in advance)
- Force majeure events (carrier outages, natural disasters, etc.)
- Incidents caused by Client actions
- Large-scale DDoS attacks
In case of SLA non-compliance in a monthly period, the Client may request a credit according to the following schedule:

Compensation is granted as credit on the next invoice, upon written request within 15 days of the incident.
12. Backups
inyx.io performs automatic daily backups of all hosted data. These backups are retained for 30 rolling days.
These backups serve as a safety net and do not substitute for the Client's responsibility to maintain their own backups. inyx.io is not responsible for data loss resulting from Client error (accidental deletion, mishandling, etc.).
Backup restoration is available self-service from the control panel. Technical assistance for restoration may be requested from support.
13. Liability
inyx.io's liability is limited to direct and foreseeable damages resulting from service provision, up to the amount of fees actually paid by the Client for the service in question over the preceding 12 months.
inyx.io is not responsible for:
- Indirect damages (loss of revenue, loss of business, commercial harm)
- Consequences resulting from non-compliant use of these Terms
- Outages or interruptions caused by third parties (network operators, etc.)
- Content published by the Client
- Security breaches resulting from Client-neglected third-party software updates
14. Intellectual Property
The Client retains all intellectual property rights to the content they host via inyx.io services.
inyx.io claims no ownership rights over Client content. Rights granted to inyx.io are limited to those strictly necessary for service provision (storage, transmission, backup).
15. Data Processing and GDPR
inyx.io commits to processing Client personal data in accordance with its Privacy Policy and the GDPR.
In providing the service, inyx.io acts as a processor for data hosted by the Client (end-user data). The Client is responsible for such data processing under the GDPR. Upon request, inyx.io may provide a Data Processing Agreement (DPA) compliant with the GDPR.
16. Service Suspension
inyx.io reserves the right to immediately suspend a service in case of:
- Suspected or malicious activity detected (spam, malware, DDoS)
- Clear violation of these Terms
- Request from a competent judicial or administrative authority
- Imminent risk to infrastructure security or other clients
In case of suspension for malicious activity, inyx.io informs the Client by email as soon as possible and provides justification for the suspension.
17. Changes to Terms
inyx.io reserves the right to modify these Terms at any time. Modifications will be notified to the Client by email with 30 days' notice. Continued use of the service after this period constitutes acceptance of the new conditions.
If the Client refuses the new conditions, they may terminate their contract without charge within the notice period.
18. Disputes and Applicable Law
These Terms are governed by French law.
In case of dispute, the parties commit to seeking an amicable solution within 30 days of notification of the dispute by email.
Failing amicable resolution:
- For consumers: possibility of resorting to consumer mediation. Competent mediator: [MEDIATOR NAME] — [URL]
- For professionals: disputes fall under the exclusive jurisdiction of the Commercial Court of [CITY]
